All fake coins, fake U.S. or foreign government papers or securities, and any tools, materials, or items made or used to make those fakes that are found with someone who does not have permission from the Secretary of the Treasury or another authorized official must be turned over to the United States. A person who has custody of such items and refuses to give them up when a Treasury agent or other proper official asks can be fined under this law, jailed for up to one year, or both. If someone with an interest in seized items files a petition with the Secretary of the Treasury before the items are disposed of, the Secretary may cancel or reduce the seizure if the person did not act with willful negligence or did not intend to break the law, or if there are other fair reasons. If the seizure involves crimes besides counterfeit money or securities, the petition goes to the Attorney General, who may also cancel or reduce the seizure.
