Title 18 › PART I — CRIMES › CHAPTER 42 — EXTORTIONATE CREDIT TRANSACTIONS › § 891
Defines key words used in this chapter. Extending credit means making or renewing a loan or agreeing to let someone delay paying a debt. A creditor is the person who makes that loan or someone who steps in for them. A debtor is the person who gets the loan or who guarantees or promises to cover it. Repayment means paying back or otherwise settling the debt, in whole or in part. Collecting credit means trying to get someone to pay. An extortionate extension of credit is a loan made when both sides understand that late or missed payments might lead to violence or other crimes. An extortionate means uses or threatens violence or other crimes to hurt a person, their reputation, or property. "State" includes the District of Columbia, Puerto Rico, and U.S. territories and possessions. Courts must take judicial notice of state laws about enforcing debt repayment, without limiting other powers they already have.
