A customs collector can refuse a ship clearance and stop it from leaving if the vessel doesn’t seem entitled to leave or if there is reason to believe the sworn statements required under section 965 are false. The head of the department or agency that handles vessel clearance can review that decision. The collector may serve a formal notice to the owner, captain, or person in charge, and then it is illegal for the vessel to depart. Anyone who takes or tries to take the vessel away in violation of that order can be fined, imprisoned for not more than 10 years, or both. The ship, its tackle, apparel, furniture, equipment, and cargo can be seized and forfeited to the United States.
