If you fail to list an item on your customs declaration or you don't tell the officer about it before your baggage is checked — whether you were supposed to write it down or say it out loud — you will owe a penalty. For illegal drugs the fine is either $500 or 1,000 percent of the drug’s value, whichever is larger. For any other item the penalty equals the value of the item. The Secretary, working with the Attorney General, will decide how much each illegal drug is worth for this rule. They must also create a method to figure the likely street price for each controlled substance.
