If a ship, vehicle, aircraft, goods, or baggage is seized, you can file a claim within 20 days after the first public notice of the seizure with the customs officer in charge. When you file, you must post a bond to the United States for either $5,000 or 10% of the claimed property’s value, whichever is lower, but never less than $250. The bond must have sureties the customs officer approves and must promise to pay all costs and expenses if the items are later condemned. The customs officer will send your claim, the bond, and a second copy listing and describing the seized items to the U.S. attorney for the district where the seizure happened. The U.S. attorney will then begin the condemnation proceedings as the law requires.
