Title 19 › Chapter 4— TARIFF ACT OF 1930 › Subtitle SUBTITLE III— ADMINISTRATIVE PROVISIONS › Part V— Enforcement Provisions › § 1611
The Secretary of the Treasury can move seized vessels, vehicles, aircraft, goods, or baggage to another customs district for sale if state law bans a sale where they were taken or if selling elsewhere would bring a better price. A court, when ordering forfeiture, can direct that the seized items be turned over to the Secretary for handling. If selling would not cover the sale costs, the Secretary may order customs officers to destroy the items. Goods illegal to sell or use under U.S. or state law may be destroyed or remade into a legal product, and any money from that product goes to the United States.
