If a countervailing duty order covers goods from a country that becomes a Subsidies Agreement country, or if a court issues such an order after that date, anyone can ask the U.S. International Trade Commission to investigate whether lifting the order would seriously harm U.S. industry. The request must be filed within 6 months after the country becomes a Subsidies Agreement country or within 6 months after the court-issued order. Customs entries of the goods made on or after those dates are treated as covered while the investigation is pending. The Commission normally must decide within 1 year of starting the investigation, though for requests received right after the WTO rules take effect the agency may spread decisions over a 4-year period. The Commerce Department must tell the Commission the likely net subsidy amount and the type of subsidy, and the Commission must use that information. If the Commission finds harm would continue, the Commerce Department stops the hold on liquidation and the duty order stays in effect until formally revoked. If the Commission finds no likely harm, Commerce must revoke the order and refund any duties collected during the hold, with interest. If no request is filed in time, the Commission treats that as a negative finding and the order is revoked with refunds. The agencies must publish notices of starts, decisions, and revocations. Parties can also ask for a related duty review at the same time; Commerce may refuse such a review if the requester is a related party or certain importers. The Commission will combine and decide linked reviews and investigations together.
