Even if section 1615 applies, when the United States files a forfeiture case under this chapter and someone claims the item, the United States must prove certain facts. For materials covered by section 2606, it must show the Secretary listed the material under section 2604. For articles covered by section 2607, it must show the item is listed in a museum, religious or secular public monument, or similar institution’s inventory in a State Party, and that it was stolen from that institution after the effective date of this chapter or after the date the Convention entered into force for that State Party, whichever date is later.
