Lets U.S. Customs change final duty decisions and give back extra customs paid on certain textile or clothing imports from CAFTA‑DR countries. The import must be from a CAFTA‑DR country the U.S. Trade Representative names as eligible. The goods must be ones that would have counted as originating under the agreement if they had been entered after that country’s agreement took effect. The import date must be on or after January 1, 2004 and before the agreement took effect for that country or any CAFTA‑DR country. The importer must have paid more than the duty rate listed for that good in the U.S. Schedule at Annex 3.3. The U.S. Trade Representative will list eligible countries in the Federal Register. To get a change or refund, a request must be filed with U.S. Customs and Border Protection within the time CBP sets by rule, after consulting the Treasury. The request must give enough information to find or rebuild the entry and to prove the goods meet the rules. “Entry” also includes withdrawing goods from a warehouse for consumption.
