When the Commission finds in a Trade Act investigation that imports are causing serious injury, it must also say whether the imports from each CAFTA–DR country that count as "originating goods" under section 4033(b) were a substantial cause. The Commission must report that finding to the President at the same time as the injury finding. If the Commission finds a country's originating goods were not a substantial cause, the President may choose to exclude that country's goods from any action under the Trade Act.
