Title 19 › CHAPTER 27 — BIPARTISAN CONGRESSIONAL TRADE PRIORITIES AND ACCOUNTABILITY › § 4203
Requires the U.S. Trade Representative to keep Congress and the public closely informed during trade negotiations. The Trade Representative must meet with any Member of Congress who asks about negotiating goals, progress, and any changes to U.S. laws that might be needed. Members may get relevant documents, including classified ones, if they have the right clearance. The Trade Representative must work closely and in a timely way with the House Ways and Means Committee, the Senate Finance Committee, the House and Senate advisory groups on negotiations, and any committees whose laws could be affected. For farm deals, the House and Senate Agriculture Committees must also be fully briefed. Before a trade agreement goes into force, the Trade Representative must tell Congress what steps the trading partner has taken to meet the agreement’s requirements. Within 120 days after June 29, 2015, the Trade Representative must write and share rules to improve coordination. Those rules must make sure Members and cleared staff get timely briefings and documents, and that federal agencies who might be affected get copies. Each Congress, the Speaker (for the House) and the President pro tempore (for the Senate) may name congressional advisers on trade. The Trade Representative must consult these advisers, including just before initialing an agreement, and formally accredit them to join U.S. negotiating delegations. The chairmen of Ways and Means and Finance must set up House and Senate advisory groups by the deadlines in the law. Those groups advise on objectives, strategies, and enforcement, get accredited access, and can ask the President to meet them before negotiations start. The Trade Representative must also write public-engagement rules within 120 days after June 29, 2015 to promote transparency, rapid public disclosure, and chances for comment, and must create similar coordination rules for statutory advisory committees.
