If a rapid response panel under Annex 31–A of the USMCA finds a denial of rights, the U.S. Trade Representative, after talking with the appropriate congressional committees, may tell the Secretary of the Treasury to stop goods from a covered facility from entering the country or to let them enter only if duties and any penalties are paid. The Trade Representative can also apply duties or penalties to entries whose liquidation was suspended under section 4692 and use other remedies allowed by Annex 31–A until the denial is fixed. The Trade Representative must promptly tell the Secretary when the denial has been remedied, as described in subsection (b).
