In civil cases under the revenue laws, a government lawyer can ask the court in writing for a specific business book, invoice, or paper that they think will help prove the government's claim. The court may order the defendant or claimant to bring that item to court at a set time. The order and the lawyer’s written request must be formally served, usually by the U.S. marshal or the same way other court notices are served. If the person fails to bring the item and cannot satisfy the court with an explanation, the facts in the lawyer’s request can be treated as admitted. If the records are brought, the government lawyer may examine the parts that relate to the claim under the court’s direction. The defendant or their agent may attend the examination. The owner keeps control of the records except while they are being looked at in court.
