The Architect of the Capitol may lease real estate for the Library of Congress anywhere in a State or the District of Columbia if budget money is available. The Architect and the Librarian of Congress must send a joint request to the Joint Committee on the Library and to the House and Senate Appropriations Committees, and each of those committees must approve the request. If those committees approve, the Architect and the Librarian may transfer appropriations or other available funds between them to pay for the lease and necessary related costs. They may not commit money before it is available or spend more than the available appropriations. This applies for fiscal year 2009 and each succeeding fiscal year.
