The Architect of the Capitol can make cooperative agreements, with the Joint Committee on the Library’s direction, to help the United States Botanic Garden do its work. The Architect can also make no-cost contracts, cooperative agreements, or memoranda of understanding with qualified groups to run or support educational exhibits, programs, classes, or outreach. Those groups may charge fees to cover program costs and may get short-term concessions for things like food or merchandise tied to the education activities. Section 5104(c) of title 40 does not apply to these activities. A "qualified entity" means the National Fund for the United States Botanic Garden and other organizations described in section 501(c) of title 26 and exempt under section 501(a) that the Architect finds share interests that complement the Garden’s educational mission. These authorities cannot be used for building or improving real property and apply starting in fiscal year 2015 and each year after.
