Pay increases for offices or jobs covered by parts (A)–(D) of section 356 must not start until the next Congress begins after the one that passed the law. If a law is passed between the Tuesday after the first Monday in November of an even-numbered year and noon on January 3, it is treated as if it was passed in the first session of the next Congress. This delay does not apply to increases that already take effect under earlier parts of this chapter; to increases based on the Employment Cost Index (per section 704(a)(1) of the Ethics Reform Act of 1989) or that replace such an index-based change; or to increases under sections 702 or 703 of the Ethics Reform Act of 1989.
