Title 2 › CHAPTER 45 — CONGRESSIONAL PAY AND BENEFITS › SUBCHAPTER I — GENERAL › Part A — Amount and Type › § 4505
Allows leaders of legislative offices to set up a program that offers one-time cash bonuses to encourage eligible workers to quit or retire. Payments are made in a single lump sum after the person leaves. The amount is the smaller of what the employee would get under 5 U.S.C. 5595(c) if eligible, or an amount set by the office head up to $25,000. The bonus is only for voluntary separations, cannot be used to increase other government benefits or severance calculations, and must be paid from money available for the employee’s basic pay. Before paying any bonuses, the office head must get an approved plan from the relevant House or Senate committees (not the Appropriations Committees). The plan must show which jobs will be cut, which workers are offered the incentive, the time period, how many and how much will be offered, and how the office will run afterward. Eligible employee: someone hired with no time limit on their appointment and with at least 3 years of continuous service. Excluded are reemployed annuitants, employees eligible for disability retirement, those with an involuntary removal notice for misconduct or poor performance, anyone who already got such a bonus before, employees with statutory reemployment transfer rights, and people who received certain student loan, recruitment/relocation, or retention bonuses in the prior 36, 24, or 12 months respectively. If someone takes the bonus and returns to U.S. government work within 5 years, they must repay the full amount, but repayment can be waived if the person has unique skills and is the only qualified applicant (waiver rules differ by branch). Personal services contracts count as government employment for repayment. The rule took effect on December 8, 2004 and applies to the part of fiscal year 2005 on and after that date and to later years.
