Title 20 › Chapter 80— STATE FISCAL STABILIZATION FUND › § 10012
Secretary of Education may waive or change funding rules for States and local agencies with revenue drops. Waivers may cover fiscal year 2009, 2010, or 2011. A waiver is granted only if the State does not give a smaller share of total state revenues to elementary, secondary, and public higher education than prior year. With Secretary approval, some federal education funds may count as non‑Federal for other programs’ effort rules (including Part C of IDEA, 20 U.S.C. 1431 et seq.), but this cannot reduce next fiscal year’s effort.
