A Part B institution will not get its federal grant money under section 1063 unless it meets the requirements of subparagraphs (C), (D), and (E) of section 1058(b)(1) and files an application with the Secretary when and how the Secretary requires. The application must say the money will be used for the purposes in section 1062, include an audit done at least once every 2 years by a qualified, independent auditor under Comptroller General standards (or use an audit done under chapter 75 of title 31 instead), and send the audit results to the Secretary. The Secretary must approve any application that meets these rules and cannot reject or change one without giving the institution notice and a chance for a hearing. Each application must also list measurable goals for financial management and academic programs and explain how the institution will meet those goals.
