Title 20 › CHAPTER 28 — HIGHER EDUCATION RESOURCES AND STUDENT ASSISTANCE › SUBCHAPTER IV — STUDENT ASSISTANCE › Part G — General Provisions Relating to Student Assistance Programs › § 1095a
A guaranty agency, or the Secretary when the Secretary holds the loan, can take part of a person’s paycheck to collect overdue student loan money if the person is not making required payments. The amount taken in any pay period can’t be more than 15% of the pay left after required tax and other legal withholdings unless the person agrees in writing to a larger percentage. The agency or Secretary must mail a written notice at least 30 days before starting garnishment. The person can see and copy the loan records, try to make a written repayment plan, and ask for a hearing about whether the debt is real or how much it is. If someone is rehired after being laid off, no money can be taken until they have worked continuously for 12 months. Employers must follow withholding orders and can be sued if they don’t, but they don’t have to change their normal payroll schedule. Employers may not fire or punish someone because their wages are garnished; an employee who is punished can sue and may get back pay, reinstatement, attorneys’ fees, and possibly punitive damages. If the person asks for a hearing within 15 days after the mailed notice, the hearing must happen before garnishment. If they ask later, they can still get a hearing but garnishment may already have started. The hearing official can’t be controlled by the agency head (an administrative law judge is allowed), and a final decision must be made within 60 days of the hearing request. The employer’s notice will only include the information needed to carry out the withholding. Student grants, loans, or work-study money and property tied to them cannot be garnished for other debts, except debts owed to the Secretary under this law. “Disposable pay” means pay left after legally required withholdings.
