Agencies must not make any regulation that affects colleges or universities effective if the rule was issued on or after October 3, 1980, unless they publish the proposed rule in the Federal Register with an educational impact assessment. The assessment must say whether the rule asks for information another U.S. agency already collects or has, and it must be based on the official rulemaking record under section 553 of title 5, even if section 553(b) might otherwise allow an exception.
