People who get money under sections 1234a, 1234d, or 1234e, and States denied under section 1232d(a), can ask the U.S. Court of Appeals in their circuit to review a final agency action. They must file a petition within 60 days. The court clerk sends a copy to the Secretary, who files the case record under section 2112 of title 28 and cannot act until the review is finished. If the Office’s factual findings have enough evidence, the court will accept them as final. The court can send the case back for more evidence, and the Office can change its findings and send the new record to the court. The court may uphold or overturn all or part of the action. The Supreme Court may review the court’s judgment under section 1254 of title 28.
