Federal courts, departments, or agencies cannot order a plan that forces a student to be sent to a school farther away than the closest or next-closest school that offers the right grade and type of instruction. They also cannot require transportation if it would put the student’s health at risk or seriously disrupt the student’s learning. If a court with authority has ruled a school system desegregated or unitary, and later neighborhood moves change school populations, federal bodies cannot force the school system to make or change desegregation plans that would require busing students to fix those population shifts.
