Title 20 › Chapter 11— NATIONAL ARBORETUM › § 196
Allow the Secretary of Agriculture to make deals, charge fees, and accept help to support the National Arboretum, even when some federal contracting rules might otherwise apply. The Secretary can work with nonprofit scientific or educational groups and other nonprofit supporters, as long as the groups use any money they earn only for Arboretum research, education, operations, maintenance, improvements, restoration, and conservation. The Secretary can also approve concessions for food, drink, and plant sales after giving public notice and considering proposals; sell excess property to get the most money (except new seed varieties and germplasm must be shared free under section 2201 of title 7); set reasonable fees for temporary use of Arboretum space and for commercial photography or filming; publish information about the Arboretum without following federal printing rules; and license the Arboretum name and logo. Money from these activities goes into a special Treasury fund that the Secretary can spend for the Arboretum without asking Congress again. The Secretary may accept volunteers from the listed nonprofits and from individuals. A nonprofit with an agreement may recognize donors if the Secretary approves that recognition in advance, and the Secretary must broadly allow such recognition to the fullest extent federal law permits.
