Title 20 › CHAPTER 48 — DEPARTMENT OF EDUCATION › SUBCHAPTER I — GENERAL PROVISIONS › § 3403
Protect state and local control of education. Congress created the Department of Education to protect the rights of state and local governments and public and private schools to run their own programs and set their own policies. Department officials cannot direct schools' curriculum, operations, staff, accrediting bodies, or choices of books and instructional materials unless a law allows it. For eight months after May 4, 1980, the Secretary cannot withhold, suspend, or end funds for programs moved into the Department just because a State did not administer the program through a single agency required by law.
