Each yearly spending bill that pays for the Department for any fiscal year starting after September 30, 1981 must set a cap on the total number of work‑years for Department staff. Bills that only add extra money (supplemental appropriations) do not need this cap. The Secretary must divide the allowed work‑years among the Department’s parts. If the President sends a reorganization plan under chapter 9 of title 5 that moves jobs or offices into the Department, the plan message must show any needed changes to the work‑year cap. By the end of the first fiscal year that begins after May 4, 1980, the number of full‑time equivalent positions for functions moved to the Secretary or Department must be cut by 500. Counts of work‑years must include all Department employees, including consultants hired under section 3109 of title 5 and all part‑time and full‑time staff, but not students or disadvantaged‑youth special programs (including temporary summer jobs). The Director of the Office of Personnel Management (OPM) must make rules on how to count work‑years and must, no later than one year after May 4, 1980, send Congress a report on employee effects. The report must identify unneeded positions; state how many employees get pay savings; say how many were separated voluntarily or involuntarily; estimate personnel costs; describe effects on labor‑management relations; and give any needed personnel management recommendations.
