Title 20 › Chapter 49— ASBESTOS SCHOOL HAZARD DETECTION AND CONTROL › § 3610
Sets plain meanings for words used in this chapter about asbestos in schools. Asbestos means chrysotile, amosite, or crocidolite, or the fibrous forms of tremolite, anthophyllite, or actinolite. Attorney General means the Attorney General of the United States. For section 3605, “imminent hazard to the health and safety” means, under rules the Secretary makes, asbestos that is crumbly or easy to break, or is where students can reach it or it can be damaged (for example by water or air), so fibers could be released into the school. Local educational agency means an LEA as defined in section 198(a)(10) of the Elementary and Secondary Education Act of 1965, or the governing body of a nonprofit elementary or secondary school. Nonprofit elementary or secondary school means a school run by nonprofit organizations (no private owner profits) and any school of a U.S. agency. School buildings covers classrooms, labs, libraries, eating and food-prep areas, gyms for physical education, other teaching or research or administrative spaces, and needed maintenance, storage, or utility facilities. Secretary means the Secretary of Education or a designee. State means each State, the District of Columbia, the Commonwealth of Puerto Rico, Guam, American Samoa, the Virgin Islands, the Northern Mariana Islands, the Trust Territory of the Pacific Islands, the Bureau of Indian Affairs, and the Office of Overseas Schools of the Department of Defense. State educational agency has the meaning given in section 198(a)(17) of the Elementary and Secondary Education Act of 1965.
