Title 20 › Chapter 52— EDUCATION FOR ECONOMIC SECURITY › Subchapter V— ASBESTOS SCHOOL HAZARD ABATEMENT › § 4022
Creates the Asbestos Trust Fund inside the U.S. Treasury to hold money for asbestos cleanup help. Money put into the fund includes loan repayments received on or after January 1, 1987, deposits from local school agencies under title 15, section 2647(a), and money from court judgments under section 4017(a)(1). The Treasury will move those amounts from the general fund at least once a month using its estimates and will fix any over- or under-estimates later. Money not needed right away may be invested in interest‑bearing U.S. government securities. Interest and sale proceeds go back into the fund. Money in the fund can only be spent, by Congress appropriation, on the Asbestos Hazards Abatement Assistance Program under section 4014. The fund may receive repayable advances of $25,000,000 for each fiscal year 1987, 1988, 1989, and 1990. Those advances and interest must be paid back to the general fund when the Secretary says the fund has the money. Interest is set to match the current average market yield on similar U.S. securities (measured at the end of the month before the advance) and is compounded yearly. The changes take effect on January 1, 1986.
