§4416 Staff of Institute

Title 20 › Chapter 56— AMERICAN INDIAN, ALASKA NATIVE, AND NATIVE HAWAIIAN CULTURE AND ART DEVELOPMENT › Subchapter I— AMERICAN INDIANS AND ALASKA NATIVES › § 4416

Summary

Most federal civil service rules in title 5 do not apply to the Institute. The Institute President, with the Board’s approval, hires staff, sets pay (including health and retirement), and decides job duties. Pay should be similar to General Schedule rates for comparable jobs, but the Board can set pay like other colleges if needed to hire or keep people. Within 180 days after the President is named, the President must write rules about hiring, pay, job rules, firing, leave, and how to handle complaints. Firing rules must give quick, fair complaint steps and require notice plus a chance for a hearing. Employees can appeal a decision not to rehire or to fire to the Board, and the Board can reverse the President in writing. People who choose to stay in civil service will be moved under the usual laws and cannot have a lower grade or pay for at least one year after the move. The rules apply to hires after October 17, 1986; people employed before that date keep their jobs and pay unless otherwise covered. The rules do not cover contractor workers. On June 30, 1989, civil service positions at the Institute ended; those civil servants could choose to come under these Institute rules or stay in certain federal retirement systems (subchapter III of chapter 83 or chapter 84 of title 5). If they stay in those systems, the Institute treats their work as federal service and pays the required contributions. Leave pay at the end of employment follows sections 5551(a) and 6306 of title 5, except leave earned under Institute rules is handled differently; if someone moves to another federal job, that Institute leave can be moved on an adjusted basis under OPM rules. The Institute is treated as an agency under chapter 71, and employees get work-injury benefits under chapter 81 of title 5.

(2)Any individual who makes an election under paragraph (1) to continue to be subject to subchapter III of chapter 83 of title 5 or chapter 84 of such title shall, so long as continually employed by the Institute without a break in service subject to such subchapter or such chapter 84, as the case may be, continue to be treated as an employee subject to such subchapter or such chapter 84, as the case may be.
