The Secretary of Defense must give money to local school districts that have big changes in the number of military-dependent students because bases or forces change. A district can get help if at least 20% of its students are military dependents and the average daily attendance of those students changed by at least 5 percent or by 500 students between the two relevant school years. The change must be caused by things like rebasing, creating or activating military units, realignment after base closures, changes in military housing, or a signed record of decision. The payment equals a per-student rate times the net change in military-dependent students for that district. The per-student rate is all the money for that year divided by the total net changes across all eligible districts. No district may receive more than $15,000,000 in one year. Payments cannot be made after September 30, 2028. The Secretary must tell each eligible district by June 30, 2023 and by June 30 each year funds are available how much it will get, and must pay within 30 days of that notice. The Secretary must brief the Armed Services Committees by March 1, 2023 on estimated costs through September 30, 2028. The law moves $15,000,000 in appropriated funds into the Defense Education Activity account and reduces another Defense account by $15,000,000. Quick definitions: “base closure process” means closures or realignments after December 23, 2022; “local educational agency” means a school district; “military dependent students” are children of service members and DoD civilian employees; “State” means the 50 states and the District of Columbia.
