States that get Federal funds must tell the Secretary, under the Family Educational Rights and Privacy Act, not later than 2 years after January 8, 2002, that they have a way for school districts to send suspension or expulsion records to any public or private elementary or secondary school when a student is or is trying to enroll, full‑ or part‑time. This rule does not apply to disciplinary records transferred from private, parochial, or other nonpublic schools below the college level.
