§7945 Preemption and Election of State Nonapplicability

Summary

Federal rules here override any state law that conflicts with them. But they do not override a state law that gives teachers extra protection from being sued. A state can choose to make these federal rules not apply to lawsuits in its courts against teachers for claims that happen in that state. To do that, the state must pass a law that cites this subsection, says the state elects nonapplication as of a specific date, and contains nothing else.
