When a teacher is sued for something they did or didn’t do while working, the teacher only must pay the part of any noneconomic loss that matches their share of responsibility. A judge or jury decides each person’s percentage of responsibility, including people who are not part of the lawsuit, and the court will enter a separate judgment for each teacher for that share. This rule does not replace or overrule any federal or state law that gives stricter limits on shared liability.
