The Secretary must appoint a Director to run the National Museum under the Board of Trustees' policies and hire other staff who work under the Director. Heye Museum employees who worked there the day before the Heye Foundation transfers its assets to the Smithsonian must be offered Smithsonian jobs on the usual terms and with pay at least equal to what they had that day. The Secretary may hire the Director, two other staff, and those Heye employees without using the normal federal competitive hiring rules. The Secretary may set pay for the Director and the two hires outside usual federal pay classification and General Schedule rules, while Heye employees’ pay must follow those federal pay rules and not be reduced.
