The Board of Regents must make sure that when a qualified successor first takes over Audubon Terrace, at least 2,000 square feet there is open to the public and ready for showing museum objects and related exhibits. If the Board and that successor sign a written agreement, the Board may lend Smithsonian objects and give help like training, scholarships, technical support, and other non‑operating aid for that space. Any fees for loans or help must be based on the successor’s ability to pay. A "qualified successor" is a nonprofit described in section 501(c)(3) and tax‑exempt under section 501(a) of title 26 that: occupies the Audubon Terrace site at 3753 Broadway, New York, New York; is able to run the exhibition space; and agrees in good faith to respond to community cultural interests.
