§80r–6 Building for the National Museum of African American History and Culture

Summary

The Board of Regents must pick a site for the Museum within 12 months after December 16, 2003. They must choose one of four places in Washington, D.C.: the Arts and Industries Building (900 Jefferson Drive SW on the National Mall), the block surrounded by Constitution Avenue, Madison Drive, and 14th and 15th Streets NW, the “Liberty Loan” site on 14th Street SW by the 14th Street Bridge, or the “Banneker Overlook” site on 10th Street SW by L’Enfant Plaza. Those sites must be kept available until a choice is made. If the chosen site is managed by a federal agency (except the Arts and Industries Building), that agency must transfer administrative control to the Smithsonian as soon as practical. The Board must work with several planning and arts officials, the presidential commission leaders, and certain Congressional committee leaders while choosing the site. The Board may then plan, design, and build the Museum at the chosen site, working with the Council. One federal procurement rule (chapter 89 of title 40) does not apply to the Museum. The Board must pay 50 percent of the costs with federal funds and 50 percent from nonfederal sources. Congress may provide whatever money is needed to carry out these duties.
