Title 20 › Chapter 3— SMITHSONIAN INSTITUTION, NATIONAL MUSEUMS AND ART GALLERIES › Subchapter XVII— NATIONAL MUSEUM OF THE AMERICAN LATINO › § 80u
Creates the National Museum of the American Latino inside the Smithsonian. The Museum must collect, study, research, publish, and show exhibits and programs about Latino life, art, history, and culture. It must cover topics like early Latino history in what is now the United States and its territories, Latino service in the armed forces, Latino roles in movements for freedom and economic well‑being, entrepreneurship and charity, and Latino contributions to the sciences, arts, food, music, dance, film, theater, sports, and popular culture. The Museum must work with other museums, schools, and research centers and run educational and digital programs. Sets up a Board of Trustees to run the Museum’s work and advise the Board of Regents. The Board can buy, accept, loan, sell, and set rules for the Museum’s collections and programs, and it must make sure exhibits show the range of political views among Latinos. The Board can have up to 19 voting members: the Secretary of the Smithsonian, the Under Secretary for Museums and Research, the chair of the Smithsonian National Latino Board, one Regent, two Members of Congress (one from each party), and 13 people appointed by the Board of Regents. Initial appointments had to be made within 180 days after December 27, 2020. Regular appointed members serve 3‑year terms, with the first group staggered as five for 1 year, four for 2 years, and four for 3 years; no one may serve more than two full terms. Trustees serve without pay but can get travel expenses. The Board must meet at least twice a year and uses a majority for a quorum. The Secretary, after consulting the Trustees, appoints the Museum Director and may name an interim Director. The Secretary may also hire two staff who are not subject to the usual federal hiring and pay rules. The Board of Regents must choose a site in the District of Columbia within 2 years after December 27, 2020, and must consider four specific Mall‑area locations, including the Arts and Industries Building. The building must meet the recommended square footage from the earlier commission report. Costs to prepare the site must be paid half from federal funds and half from non‑federal sources. The Institute of Museum and Library Services will run grant and scholarship programs for other American Latino museums and was authorized $15,000,000 for fiscal year 2021 and whatever sums are needed for 2022 and later. The Smithsonian was authorized $20,000,000 for fiscal year 2021 and whatever sums are needed each year after; those funds remain available until spent and may be used to help raise private money. Contracts or payments under this law depend on future appropriations.
