The Institute must keep personal data private when it collects, keeps, uses, or shares it. It must follow section 552a of title 5, the law’s confidentiality rules here, and sections 1232g and 1232h of this title. The Director must protect any information that can identify students, their school records, their families, or information about individual schools. The Director must create and enforce rules so that data are used only for research, statistics, or evaluation under this part, that no publication lets a person be identified, and that only people the Director authorizes can see individual reports. No federal agency or grant recipient can force Institute staff to give out identifiable records collected under this law. Those records are protected from legal demands and generally cannot be used in court without the person’s consent, except if the person requests their own records. Employees or others who knowingly disclose prohibited identifiable data or who combine data to identify someone and then misuse it face a class E felony, with up to five years in prison or fines under section 3571 of title 18. The Director may use temporary staff if they swear to keep data secret. “Individually identifiable information” means records or survey responses that reveal a person; a “report” is a response about an individual to the Director. Certain officials (Secretary, Comptroller General, CBO Director, Librarian of Congress) may see records but must follow the same disclosure limits. The Attorney General may get a court order to access identifiable records for terrorism or certain crimes under 18 U.S.C. 2332b(g)(5)(B) or section 2331, and employees who comply in good faith are protected.
