Title 20 › Chapter 76— EDUCATION RESEARCH, STATISTICS, EVALUATION, INFORMATION, AND DISSEMINATION › Subchapter III— NATIONAL ASSESSMENT OF EDUCATIONAL PROGRESS › § 9621
Creates the National Assessment Governing Board to set the policies for the National Assessment. The Secretary appoints 25 voting members who represent state leaders, school officials, teachers, testing experts, parents, business, and the public (for example: 2 governors, 2 state legislators, 2 chief state school officers, 3 classroom teachers, 3 testing experts, and other specific slots). The Director of the Institute of Education Sciences is an ex officio, nonvoting member. The Board must reflect regional, racial, gender, and cultural diversity and must act independently, without improper influence. The Board chooses subjects to test, sets student achievement levels, writes test goals and specifications, designs testing methods with experts, and includes teachers, parents, and school leaders in review. It must test grades 4, 8, and 12, set rules for reporting and comparisons, plan the first public release of results, and work to improve test content and reporting. The Board has final say on test items and must make sure items are free from racial, cultural, gender, or regional bias and are secular, neutral, and non-ideological. Members serve staggered terms not longer than 4 years and may serve up to two terms; existing 3‑year terms in effect on December 21, 2000, were extended by 1 year. When a vacancy occurs, the Secretary fills it from nominations by relevant organizations (each must nominate six candidates) and may ask for more names if needed. The Board is independent of the Secretary and the Department. At the Board’s request, the Secretary may appoint staff, including up to six technical employees for terms not to exceed 3 years. The Board and the Commissioner for Education Statistics must meet regularly to coordinate, and the Board must report within 90 days after an evaluation of the achievement levels on steps taken to respond to recommendations. Chapter 10 of title 5 does not apply to the Board except for sections 1009, 1010, and 1011.
