Cases to enforce or stop violations under this law must be brought in the name of the United States. Federal subpoenas in those cases can require witnesses to appear in any district. A State may sue in its own name, inside its borders, to enforce section 341 or parts of 343 (b, c, d, e, f, g, h, i, k, q, r) when the food is in the State. The State must notify the Secretary and wait 30 days before suing, or 90 days if the Secretary starts enforcement within those 30 days. The State may not sue if the Secretary is already pursuing or has settled a court case or enforcement action about that food.
