Title 21 › CHAPTER 9 — FEDERAL FOOD, DRUG, AND COSMETIC ACT › SUBCHAPTER V — DRUGS AND DEVICES › Part E — General Provisions Relating to Drugs and Devices › § 360bbb–3a
The Secretary of Health and Human Services can take special steps for certain medical products during official emergencies or when a material threat is identified under section 319F–2 of the Public Health Service Act. Eligible product: an approved, cleared, conditionally approved, or licensed drug, device, or biologic meant to prevent, diagnose, or treat harm from biological, chemical, radiological, or nuclear agents or the serious illnesses they cause, and used during those official emergency or threat determinations. Product: a drug, device, or biological product. The Secretary may extend a product’s expiration date and allow it to be sold or moved across state lines after the maker’s date if the change helps public health or military readiness and is backed by scientific review. Any extension must say which lots are covered, how long the extension lasts, and any safety rules (for example testing, storage, labeling, or recordkeeping). The Secretary may also allow temporary departures from normal manufacturing rules, let products be dispensed without an individual prescription when state law allows or when the Secretary orders it, and issue emergency use instructions for providers or users. Taking these actions will not make the product count as unapproved, adulterated, or misbranded under federal law.
