Title 21 › CHAPTER 9 — FEDERAL FOOD, DRUG, AND COSMETIC ACT › SUBCHAPTER V — DRUGS AND DEVICES › Part E — General Provisions Relating to Drugs and Devices › § 360bbb–7
The Secretary can require certain drug distributors to notify the Secretary if they know a drug may cause serious injury or death in the United States, if there is a significant loss or known theft of the drug meant for U.S. use, or if the drug has been counterfeited and the fake is or could be sold in the United States or has been or may be imported. The Secretary will set how to report by rule or guidance. This does not stop the Secretary from using other laws to require notices. "Regulated person" means (1) someone who must register under section 360 or 381(s), (2) a wholesale drug distributor, or (3) any other drug distributor except one that only sells drugs at retail.
