Title 21 › CHAPTER 9 — FEDERAL FOOD, DRUG, AND COSMETIC ACT › SUBCHAPTER V — DRUGS AND DEVICES › Part G — Medical Gases › § 360ddd–1
People who want to start selling a "designated medical gas" across state lines must ask the Secretary for a certification. That request can start 180 days after July 9, 2012. The request must describe the gas, give the sponsor’s name and address, list the manufacturing site(s), and include any other information the Secretary needs. If the Secretary does not say otherwise within 60 days, the certification is treated as granted. The Secretary can deny the request if the gas is not a designated medical gas, the request lacks required information, or denying it is needed to protect public health. A certified gas is treated as having an approved drug application for certain medical uses. Examples: oxygen for treating low blood oxygen, nitrogen for hypoxic challenge testing, nitrous oxide for pain relief, carbon dioxide for certain breathing support or testing, helium for upper airway problems, medical air to reduce high oxygen risk, and carbon monoxide for lung testing. The final container must carry required labeling, a warning the Secretary sets, and storage/handling directions. Certification does not give drug exclusivity, and existing exclusivity generally cannot stop a certification except as the law specifically says. The Secretary can withdraw or suspend approvals and can revoke a certification for serious omissions or false information. In general a designated medical gas needs a prescription unless the Secretary removes that rule, it is approved without a prescription, or emergency rules apply. Oxygen may be given without a prescription for depressurization or other low-oxygen events, or for emergency resuscitation by trained staff, but its label must warn it is for emergency use only and say other medical uses need a prescription.
