Title 21 › CHAPTER 9 — FEDERAL FOOD, DRUG, AND COSMETIC ACT › SUBCHAPTER V — DRUGS AND DEVICES › Part H — Pharmaceutical Distribution Supply Chain › § 360eee–1
Requires drug makers, repackagers, wholesale distributors, and dispensers to track and share key information every time ownership of a drug product changes. The Health Secretary must create standards and guidance for how to exchange that information, get public comment for at least 60 days, and publish the standards not later than 1 year after November 27, 2013. The Secretary must also set up waiver and exemption processes not later than 2 years after November 27, 2013, hold at least 5 public meetings, and run pilot projects to test methods. If an entity fits more than one role, it must follow all rules that apply to it but need not repeat the same task twice. Manufacturers, repackagers, wholesale distributors, and dispensers must give the next owner a transaction statement, transaction information, and transaction history when they transfer a product, and keep records for at least 6 years. Manufacturers must put a product identifier on every package and homogeneous case not later than 4 years after November 27, 2013; repackagers by 5 years; wholesale distributors by 6 years; and dispensers by 7 years. By January 1, 2015, trading partners must be authorized. When a product is suspected or found to be illegitimate, holders must quarantine it, investigate, and notify the Secretary and immediate trading partners—notifications about illegitimate products must go out within 24 hours. On the date 10 years after November 27, 2013, package-level, secure, electronic tracing and faster response times (24 hours for official requests) take effect, including requirements to exchange package-level product identifiers electronically.
