Title 21 › CHAPTER 9 — FEDERAL FOOD, DRUG, AND COSMETIC ACT › SUBCHAPTER V — DRUGS AND DEVICES › Part I — Nonprescription Sunscreen and Other Active Ingredients › § 360fff–6
Requires the FDA to set clear review steps and deadlines for certain non-sunscreen over-the-counter drug applications that were pending or filed around November 26, 2014. If a company filed an eligible application before that date, it had 180 calendar days from November 26, 2014 to ask the FDA for a written framework for review. The FDA had to send that framework within 1 year after November 26, 2014, showing timelines (in calendar days) for four possible review paths. After getting the framework, a sponsor had 60 calendar days to pick which path the FDA should use. If no choice was made, the FDA would use the timelines in the final regulations once those rules were ready. The FDA can change the review path later if the sponsor agrees in writing. The FDA also had to report in writing to two Congressional committees within 18 months after November 26, 2014 about all pending applications and the timelines for each. For new eligible applications filed after November 26, 2014, the FDA had to publish proposed rules within 18 months and finish the final rules within 27 months of that date. The rules must set reasonable calendar-day timelines (which can vary by application complexity), include measurable tracking metrics, allow at least 60 calendar days for public comments, and be published at least 30 calendar days before they take effect. Timelines must reflect public health priorities and available resources.
