States and their local governments must not make or keep rules for devices meant for people that are different from or add to federal rules about safety, effectiveness, or other matters the federal law covers. The Secretary can allow a state rule to stay if the state asks. The Secretary must make a rule after notice and a chance for an oral hearing. An exemption can be granted if the state rule is stricter than the federal rule, or if it is needed because of urgent local conditions and it would not make the device break federal law.
