Title 21 › CHAPTER 9 — FEDERAL FOOD, DRUG, AND COSMETIC ACT › SUBCHAPTER V — DRUGS AND DEVICES › Part C — Electronic Product Radiation Control › § 360kk
Requires the Secretary to set safety rules for electronic products when needed to protect people from harmful electronic radiation. The rules can cover testing, labels or warnings, and instructions for use. The first rules had to be set before January 1, 1970. The Secretary must talk with federal and state agencies, experts, industry, labor, and the public and must consider the latest science, other agencies’ recommendations, how practical the rules are, and how to make testing reliable. Different products can have different standards. The Secretary can change or cancel standards, and may exempt products made only for export if they are labeled for export and meet the importing country’s rules. The Secretary may also exempt products used mainly by U.S. government agencies if those agencies have their own rules. Rulemaking and court-review procedures under federal law apply. New or changed rules normally must take effect not sooner than one year and not later than two years after they are issued, unless the Secretary finds good cause and says why. Anyone hurt by a new rule can ask a federal court of appeals to review it within 60 days. The Secretary must keep a record of rule actions and provide certified transcripts on request for the cost. The Secretary must also set up a 15-member Technical Electronic Product Radiation Safety Standards Committee (5 from government, 5 from industry, 5 from the public with at least one labor representative) to advise on standards; the committee’s meetings are recorded and public, and paid outside members are not made federal employees. The Secretary must keep checking industry testing programs. Manufacturers must put a permanent label or tag on each covered product certifying it meets the applicable standards, based on testing of the product or an approved testing program.
