Title 21 › CHAPTER 9 — FEDERAL FOOD, DRUG, AND COSMETIC ACT › SUBCHAPTER VII — GENERAL AUTHORITY › Part C — Fees › subpart 10 — fees relating to over-the-counter drugs › § 379j–72
Starts in fiscal year 2021, the government will collect two kinds of fees for over‑the‑counter (OTC) monograph drugs: an annual fee for each facility that makes those drugs, and a fee when someone files an OTC monograph order request. For facility fees, the time period used to decide who pays is: for FY2026 the 12 months ending December 31, 2025; for FY2027 the 9 months ending September 30, 2026; and for FY2028 and later the 12 months ending September 30 of the previous fiscal year. A facility that stopped all OTC monograph drug work before certain dates and updated its registration does not pay. Contract manufacturers pay two‑thirds of the normal facility fee. Facility fees are due on set dates: for FY2026 the later of the first business day in June 2026 or the first business day after an appropriations Act is passed; for FY2027 in two payments (50% due the later of October 1, 2026 or after appropriations, and 50% due February 1, 2027 or after appropriations); and for FY2028+ the later of the first business day on or after October 1 or the first business day after appropriations. Order request fees must be paid when the request is filed. A Tier 1 request costs $500,000, adjusted for inflation, and a Tier 2 request costs $100,000, adjusted for inflation. Safety labeling changes that only add or strengthen a warning, misuse risk, or safe‑use dosing instructions do not require a fee. If a Tier 1 request is reclassified as Tier 2, the requester gets the difference back. If a request is refused for filing or withdrawn before filing, 75 percent of the fee is refunded; if it is resubmitted after refusal or withdrawal, the full fee is due. The Secretary may refund fees in limited other cases and must publish final fee amounts at least 60 days before each fiscal year. Owners must report each facility annually as part of drug establishment registration. If a facility does not pay a fee within 20 days of the due date, the facility is listed publicly and its OTC monograph drugs are treated as misbranded until the fee is paid; unpaid fees become a government claim after 30 days. Fee revenue targets for FY2026–2030 are set from base revenue plus inflation, reserves, and specified add‑ons (including $2,373,000 for FY2026; $1,233,000 for FY2027; $854,000 for FY2028) and small yearly direct‑cost amounts ($135,000 for 2026; $300,000 for 2027; $55,000 for 2028; $30,000 for 2029; $0 for 2030). Fees can only be spent as allowed by Congress and some rules require non‑fee appropriations of at least $12,000,000 adjusted by the inflation factor, with a 15 percent tolerance.
