The Secretary of Health and Human Services, working through the FDA Commissioner and with U.S. Customs and Border Protection, must make and update a shared list of controlled substances to watch for in international mail. If a package looks like it may break the Controlled Substances Act, the Controlled Substances Import and Export Act, the Federal Food, Drug, and Cosmetic Act, or other federal laws, the Secretary will turn over the listed items and any similar packages to U.S. Customs and Border Protection, and Customs must accept them under the Controlled Substances Act. Within 9 months after October 24, 2018, the Secretary, through the FDA Commissioner and in consultation with the Secretary of Homeland Security, had to report to the House Committee on Energy and Commerce and the Senate Committee on Health, Education, Labor, and Pensions about how this was being put into place.
