The Secretary must write rules within 36 months after June 22, 2009, that require testing and reporting on the chemicals, ingredients, and additives in tobacco products, including chemicals in the smoke, for any brands or subbrands the Secretary finds need testing to protect public health. Products that are the same except for labels or packaging count as one brand. The rules may also require companies to tell the public about tar and nicotine test results on labels, ads, or other ways, and to disclose other test results if the Secretary decides it will help protect health and not mislead people. The Secretary can do the testing or make companies do it. The rules give small tobacco product manufacturers extra time. Small makers cannot be forced to follow the rules until the later of: the end of a 2-year period after the final rules, or the first compliance date set for larger makers. Small makers get 4 years to test and report on all their products. They must test 25 percent of their products each year and must test their biggest sellers first unless the Secretary sets a different order. The Secretary can delay a small maker’s deadlines for undue hardship, but not beyond a total of 5 years after the initial date for larger makers. New or changed products must follow the same schedule as larger makers. Small makers may join together to buy lab testing. If a small maker shows at least 90 days before a deadline that it has submitted products to a lab, the products are waiting, and no lab can finish on time at normal fees, the Secretary can delay finding a violation until testing is reported or until 1 year after the reporting deadline. The Secretary can give more one-year extensions if lab capacity is the problem. These delay rules do not change any other deadlines in the law.
